| the contract with Sailmore GbR (SAILMORE) about the delivery of articles
is concludes in the moment when the delivery is confirmed or in the moment
of the delivery of your order. Before the contract ist concluded there
is no right of delivery of the ordered goods. II. payment paypal: after receipt
of the amount the goods will be delivered.
the order leaves the SAILMORE warehouse as soon as all purchased items are available. if the order contains products which are out of stock, it will be put on hold up to four weeks until all products are available. after four weeks all available products will be delivered. the delivery will contain a note that articles not contained in the delivery have to be re-ordered. existing credits will be compensated immediately. the customer can choose not to make use of the four weeks delivery term on the order form. in this case only products on stock will be delivered and the rest of the order will be deleted. the delivery is carried out at risk of the customer. please make sure that the delivery is undamaged. to make sure that there is no damage to your delivery you might want to open the package in presence of the postman. please do not accept damaged or obviously opened packages as this means that the delivery was accepted as undamaged (in case of doubt please note name of postman).
according to German law, consumers have the right to withdraw from the
contract without giving reasons within fourteen days after receipt of
the delivery. the Right of withdrawal is irrespective of warranty. the
withdrawal can be effected in written form (e.g. letter, fax, e-mail
is sufficient) or by returning the delivered goods. for a timely withdrawal
the posting of the withdrawal or the goods is sufficient. the withdrawal
shall be addressed to:: in case of an effective withdrawal both parties´ received goods and services have to be returned and benefits (e.g. interest rates) have to be delivered. if you can not return delivered goods or services fully or only partly or only in a deteriorated quality, the difference has to be reimbursed. this does not apply in case of delivered goods if the deterioration of the quality of the goods is only due to the examination of the goods as possible in a retail shop. you can also avoid SAILMOREs claim of reimbursement if you do not make use of the delivered goods like an owner and refrain from usage that might deteriorate their value. transportable delivered goods shall be returned at SAILMORE´s risk ant cost if the value of the order does not fall below € 60,00. If the value of the order falls below € 60,00 customer is responsible for the return of the goods. not transportable goods will be picked up.
VII. protection of privacy the information you send us (name, address, date of birth, e-mail address, telephone, fax, bank details, credit card details) are solely used in correspondence with German data privacy laws. your personal information which you enter or transmit and which are necessary for the accomplishment or amendment of a contract will solely be used for the execution of the contract, e.g. for the shipping of your order to the address given to us. we share customer information for advertisement purposes, market research or promotional offers only upon your consent. you always have the opportunity to declare your consent before sending your order. your consent is voluntary and can be revoked at any time on our web site.VIII. final provisions the nullity or invalidity of one or more provisions shall not affect the validity of the remaining provisions. avalid provision shall be considered agreed upon instead, which is closest to the economic purpose of the provision. the same applies to gaps. |
